Terms
Please read these Terms and Conditions (“Terms”) carefully before using paid products or services offered (the “Service”) and operated by Ola Expeditions, LLC ("Ola Expeditions", “us”, “we”, or “our”). Ola Expeditions has been hired to plan a celebration for Briana Cousins in Sicily, Italy. Access to and use of the Service is conditioned on acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others (“Traveler” or "Travelers") who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. By participating in an experience arranged by Ola Expeditions, Traveler represents and warrants that: (a) Traveler is of sufficient age to participate and can create binding legal obligations. (b) Traveler is legally authorized to act on behalf of any individuals he/she represents and accept these Terms on their behalf. (c) The information Traveler provides is true and accurate.
VIOLATIONS. Any violation of these Terms may result in: (a) Cancellation of participation in the experience. (b) Forfeiture of any payments made. (c) Denial of access to certain travel-related services or activities.

CHANGES TO TERMS AND CONDITIONS. Ola Expeditions reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and take effect immediately upon posting. If material changes occur, we will notify Travelers. Please review these Terms regularly, especially before making any arrangements. Continued participation in our experiences after any modifications constitutes acceptance of the updated Terms.
HEALTH AND LIABILITY. Traveler acknowledges the risks of COVID-19 and other illnesses, including exposure, illness, or death. Travel plans may change or be canceled due to restrictions, often without refunds. Ola Expeditions strongly recommends travel protection, including cancel-for-any-reason coverage. Ola Expeditions is NOT LIABLE for losses. By participating, all Travelers release and hold harmless Ola Expeditions and its affiliates from any COVID-19-related claims or losses, including those due to negligence. This liability release remains in effect even after cancellation.
SCOPE/AGENCY. Ola Expeditions does not provide, own, or control the travel services and products included in this trip, such as flights, accommodations, excursions, rental cars, drivers, or travel insurance (collectively, “Travel Products”). These services are provided by independent third-party suppliers (“Suppliers”) such as hotels and tour operators. Ola Expeditions acts solely as an agent in facilitating travel experiences and is not responsible for any loss, accident, injury, delay, or other irregularity that may occur due to a Supplier’s actions or inactions. Participants acknowledge that Ola Expeditions does not assume liability for any issues, including but not limited to loss, injury, or damage, arising from third-party provided services.

BOOKING/PAYMENT. Travelers are to fill out the contact form provided with the document titled Travel Proposal (the "Travel Proposal") and make the deposit and all subsequent payments via the link Ola Expeditions provides to Travelers or via Zelle. Bookings will be confirmed after the required deposit and all payments are made, and the Travel Proposal is signed and returned. Payments made via credit card, debit card, or other electronic payment methods are subject to a surcharge. This fee is applied to cover processing costs and will be disclosed at the time of payment. By proceeding with payment through these methods, Traveler acknowledges and agree to the applicable surcharge. Traveler authorizes Ola Expeditions to enroll Traveler in hotel and accommodation loyalty programs as necessary to secure discounted rates and exclusive benefits. This enrollment is solely for the purpose of enhancing the travel experience and does not obligate Traveler to any future commitments with the respective loyalty programs.

TRAVEL PROTECTION. We understand that unforeseen circumstances may come up that may affect travel. Please note that due to the nature of our business, all deposits and payments are NON-REFUNDABLE unless stated otherwise. Travel protection is strongly recommended to cover trip cancellations, medical emergencies, evacuations, and baggage loss. Ola Expeditions is not responsible for explaining coverage details or ensuring Traveler meets
insurance requirements. Some countries require valid medical insurance for entry, and we are not liable for denied access due to missing coverage.

TRAVELER INFORMATION. Names provided to secure reservations must match Traveler's passports. Date of birth and complete passport details are required. Traveler voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation.

CREDIT CARD BOOKINGS. We accept Visa, Mastercard, American Express, and Discover. A signed or digital authorization is required for all transactions, confirming your agreement to our terms, including cancellation policies. Chargebacks should not be used improperly. If there are any concerns, contact us first. We reserve the right to dispute improper chargebacks and recover associated costs. In such cases, travel reservations may be canceled. Improper chargebacks include but are not limited to: (a) Non-cancelable reservations, whether used or not. (b) Charges authorized by family, friends, or associates with direct card access (excluding fraud). (c) Disputes over supplier product descriptions. (d) Situations beyond our or the supplier’s control (force majeure). (e) Disagreements with cancellation policies.

PRICE AND RATE CHANGES. The itinerary price is based on costs at the time of issue and may change due to Supplier rates, taxes, or currency fluctuations until final payment. After final payment, the price is locked, but we reserve the right to correct errors before confirmation.

CANCELLATIONS AND REFUNDS. If before the actual date of travel unforeseen circumstances require changes to the trip, Ola Expeditions will work to provide alternatives of comparable feature. Ola Expeditions reserves the right to cancel or vary any itinerary and substitute components, including but not limited to hotels, restaurants, and tours, of comparable quality. These changes will not be considered material changes and will not be considered cause
for cancellation.

FORCE MAJEURE. Ola Expeditions assumes NO LIABILITY for any loss, damage, delay, or cancellation caused by Acts of God or other force majeure events, including but not limited to: fire, volcanic eruptions, hurricanes, extreme weather, floods, earthquakes, power or water failures, riots, strikes, terrorism, war, government actions, health advisories, pandemics, or any unforeseen circumstances that hinder its ability to fulfill contractual obligations. In such cases,
we are not required to issue refunds, but any recoverable funds from third parties will be proportionally refunded to Travelers without charge by Ola Expeditions.

DESTINATIONS AND DOCUMENTATION. Some destinations carry risks. Travelers should check https://www.state.gov and https://www.cdc.gov for advisories. Travelers are responsible for entry requirements, including visas, COVID-19 protocols, and local laws. Ola Expeditions is NOT LIABLE for travel warnings or missing documentation. Passports must be valid six months beyond entry with at least two blank pages for entry/exit stamps, and minors may need consent forms. Failure to comply may result in denied boarding or entry, with Ola Expeditions NOT RESPONSIBLE for delays or losses.

INSECTICIDE NOTICE. Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s Web site, as this list is updated from time to time: https://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

ASSUMPTION OF RISK/WAIVER: Travelers acknowledge the risks of travel, including accidents, illnesses, and unforeseen dangers. Ola Expeditions is not liable for injuries, damages, or losses arising from travel-related risks. By booking, Travelers assume full responsibility and agree not to hold Ola Expeditions liable. This waiver applies to all claims, including third-party negligence.

INDEMNIFICATION: Travelers indemnify and hold Ola Expeditions harmless from any claims, damages, or legal costs related to their actions. This includes violations of the Terms and damages caused while on the trip.

PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES: Travelers with disabilities or medical conditions must inform Ola Expeditions before booking. While accommodations will be communicated to Suppliers, they are not guaranteed and may not meet ADA standards outside the USA.

PHOTOGRAPHS/VIDEOS: Travelers agree that Ola Expeditions may use photos or videos taken during trips in any manner or medium to promote its Services. Travelers who do not want their image published in this manner must notify Ola Expeditions in writing at info@nnennathenavigator.com and provide a photograph for identification purposes.

MEDIATION AND SMALL CLAIMS COURT: Any dispute under these Terms shall be resolved by mediation in Georgia. IF EITHER PARTY ELECTS MEDIATION, IT IS FINAL AND BINDING UPON AGREEMENT, WAIVING THE RIGHT TO LITIGATE. A neutral mediator, jointly selected, will help the parties reach a resolution. If mediation is unsuccessful, any party can litigate at a local small claims court in Georgia. Travelers waive the right to appeal small claims court decision.

ENTIRE AGREEMENT & SEVERABILITY: These Terms, along with the Travel Proposal, govern the trip with Ola Expeditions, overriding prior communications. If any part is found unenforceable, the rest remains valid.
